Terms & Conditions

Acceptance of Orders

Any orders placed either electronically or otherwise are subject to acceptance at our discretion.

We reserve the right ot suspend delivery in the event of our account not being paid to terms or to reduce or cancel orders in the event that we are unable, through shortages of stock or any other reason, to fulfill them either wholly or in part.

Prices

Prices quoted are subject to VAT where applicable and are subject to change withourt notice. Goods will be invoiced at the price current on the day of delivery. We reserve the right to withdraw or cancel promotions at any time.

Payment

All goods must be paid for in Cash immediately upon receipt unless Credit or Cheque payment facilities have been agreed and intimated by us in writing.Payment for items appearing on a an Account statement must be recieved at our office or paid directly into our Bank Account on or before the due date as agreed between us.

Cheques should be drawn in favour of Braeview Ltd and must not be post dated unless by prior written consent. we reserve the right to refuse to accept payment by cheque at our sole discretion.

An administration charge of £5 is payable in the event of late payment.

Interest is chargeable on overdue accounts at Base Rate plus 5%.

Credit Account

Credit facilities may be agreed at our sole discretion & upon full completion of our Account Application form. For limited Companies, personal Guarantees may be required from the Directors of the Company.

All credit accounts once agreed in writing by us, are payable by 14 day Direct Debit. If for any reason Direct Debits are cancelled or returned unpaid, we reserve to withdraw or alter any previously agreed credit facilities.

Notwithstanding the above, we reserve the right to withdraw or refuse credit facilities at any time and at our sole discretion.

Returned Cheque/Direct Debit Fees

An administration fee of £30 is chargeable on cheques, direct debits or any other instrument of payment returned to us unpaid by your Bankers for any reason whatsoever.We reserve the right to increase this fee at any time without prior notice.

Delivery

Delivery times quoted or agreed by us are estimated only and whilst every effort will be made to comply with these they shall not be the essence of the contract.

Risk & Title

Risk in the Goods shall pass to you on delivery to you or your agent or on collection by you or your agent. We will retain title in the goods until we receive payment in full for ANY outstanding amounts due by you to us. If payment is overdue in whole or in part, we may, without prjudice to any of our other rights, recover or recall the goods or any items of them and we may enter upon your premises or any other premises where the goods are stored, for that purpose.

Minimum Order

We reserve the right to amend or impose minimum orders in either quantity or value. Furthermore we reserve the right to refuse delivery for any reason and at our sole discretion.

Damaged Goods, Best Before Dates, Non-Delivery, Shortages

All delievries must be checked before signing delivery documents as no claims will be accepted retrospectively. Delivery documents signed as unchecked will deem to accept the goods in good and saleable condition with no shortages and acceptable best before, use by or sell by dates.Any failure to report aforesaid will not be accepted as reason for non-payment.

Open Date Marketing

None of our goods are offered on a sale or return basis and our representatives are not authorised to accept orders or make deliveries on such a basis. It is your responsibility to sell the goods prior to best before, use by or sell by dates. We will endeavour on our part to supply all goods with a reasonable shelf life which, in any event, will vary from product to product.

Consumer Complaints

Any consumer complaints arising from any products supplied by us must be reported to us in writing. We accept no liability for any payments of compensation made by you to the consumer.

Terms of Contract

These Terms and Conditions of sale shall be the only terms of contract between us. No other conditions shall have effect unless agreed in writing by us. Our representatives, depot staff, delivery drivers or any other employees of our company or any agents acting on behalf of our company are not authorised to agree or offer any other terms or conditions or to vary these conditions of sale.

These terms and conditions are accepted by you on placing any order or acceptance of any delivery from our company.
